Where we rely on legitimate interests, we consider whether those interests are overridden by your rights and freedoms.

Where processing is based on consent, you may withdraw that consent at any time. Withdrawal does not make earlier processing unlawful.

8. Purchases and payments

Payments may be processed by:

- Stripe;
- PayPal;
- other payment providers; and
- payment functionality made available through Bandzoogle.

Payment providers may collect and process information under their own privacy policies, legal obligations and fraud-prevention procedures.

We ordinarily receive transaction confirmation rather than complete card or bank-account credentials.

Payment providers may make automated assessments designed to detect fraud, unauthorized use or security risks. Their own notices should explain any independent processing they conduct.

9. Marketing communications

We will send promotional emails, newsletters or similar electronic marketing only where we have an appropriate lawful basis.

Marketing messages may include information about:

- new songs and releases;
- music videos;
- products and merchandise;
- memberships;
- services;
- events or appearances;
- exclusive content;
- discounts;
- competitions; and
- other GOTZ news.

You may unsubscribe at any time by:

- selecting the unsubscribe link in an email;
- changing available account preferences; or
- contacting gotz4real@gmail.com.

Unsubscribing from promotional messages will not prevent necessary messages relating to an existing order, account, membership, booking or legal matter.

After an unsubscribe request, we may retain limited information on a suppression list so that we can respect your choice and avoid adding the address back to marketing lists.

Consent to marketing is not a condition of purchasing a product unless the marketing communication is itself the service you specifically requested.

10. Cookies, analytics and advertising

10.1 Strictly necessary technologies

Certain cookies and similar technologies may be necessary to:

- load the Website;
- maintain security;
- remember privacy choices;
- operate a shopping cart;
- process checkout;
- authenticate accounts;
- provide memberships;
- prevent fraud; and

Where permitted by law, these technologies may operate without consent because they are necessary for the requested service.

10.2 Optional technologies

With consent where required, we may use optional technologies for:

- audience measurement;
- Website analytics;
- remembering non-essential preferences;
- embedded music or video;
- advertising measurement;
- conversion tracking;

Optional technologies must not be activated before the required consent is obtained.

You should be able to reject non-essential technologies and later change your preferences through the Website’s cookie or privacy settings.

10.3 Providers that may be used

Depending on the integrations enabled on the Website, providers may include:

- Bandzoogle analytics;
- Google Analytics;
- Meta Pixel;
- Google Ads;
- TikTok Pixel;
- YouTube;
- Spotify;
- SoundCloud;
- Bandcamp;
- Bandsintown;
- other providers.

The final Cookie Policy must identify the technologies actually enabled, their purposes, providers and storage periods.

10.4 Browser signals

Some browsers transmit privacy signals such as “Do Not Track” or opt-out preference signals.

Traditional “Do Not Track” signals are not governed by a single universal standard.
Where required by applicable law, we recognize supported opt-out preference signals, such as Global Privacy Control, as a request to opt out of sale, sharing or targeted advertising for the browser or device sending the signal.

11. Embedded music, video and social-media content

The Website may display content or features from third parties such as YouTube, Spotify, SoundCloud, Bandcamp, Instagram, Facebook, TikTok, X, Bandsintown or other platforms.

When an embedded feature is activated, the relevant provider may receive:

- your IP address;
- device and browser information;
- the page visited;
- cookie or account identifiers; and
- information about your interaction with the content.

If you are logged into the third-party platform, it may connect the interaction with your platform account.

Where required, non-essential embedded content should remain blocked until you consent to the relevant cookie category.

Third-party platforms process data under their own privacy policies. GOTZ does not control their independent processing.

Where appropriate, recipients acting on our behalf are required to process personal information only for authorized purposes and to apply suitable confidentiality and security measures.

13. Creative files and artificial intelligence

Creative-service materials may include recordings, vocals, photographs, videos, lyrics, compositions, project files and other potentially identifying content.

We may use specifically identified AI-assisted production or business tools to perform requested services, such as ChatGPT, Google Gemini, Suno or others. Before using personal or confidential project material with such a provider, we will consider the purpose, provider terms, privacy safeguards and whether separate notice or permission is required.

We will not authorize a provider to use customer material for unrelated model training where an appropriate opt-out or restricted-processing setting is available and the material is confidential or supplied for a paid project.

14. Sale, sharing and targeted advertising disclosures

We do not sell personal information to data brokers or third parties in exchange for money.

However, certain advertising cookies, pixels or similar technologies may be considered a “sale,” “sharing,” targeted advertising or cross-context behavioural advertising under some privacy laws, even where no money is exchanged.

Where such technologies are used and applicable law grants an opt-out right, you may exercise that right through:

- the Website’s cookie settings; or
- an email or postal notice.

We do not knowingly sell or share personal information belonging to children under 16.

15. International transfers

GOTZ and Gotz Music Independent are established in Croatia, within the European Economic Area.

Some service providers may process information in the United States, Canada, the United Kingdom or other countries outside Croatia or the European Economic Area.

Those countries may have privacy laws that differ from the laws of your country.

Where we are responsible for transferring personal data from the European Economic Area, United Kingdom or another jurisdiction that restricts international transfers, we will rely on an available lawful transfer mechanism, such as:

- an adequacy decision;
- approved standard contractual clauses;
- an applicable data-privacy framework;
- binding corporate rules;
- contractual safeguards recognized by applicable law;
- your explicit consent in the limited circumstances where that is legally appropriate; or
- another lawful derogation or transfer mechanism.

Where required, we will assess whether supplementary contractual, organizational or technical safeguards are appropriate.

You may contact us for further information about the transfer mechanisms relevant to your information, subject to confidentiality and security restrictions.

Where a personal-data breach creates a legal notification obligation, we will notify the appropriate supervisory authority and affected individuals as required by applicable law.

18. Automated decision-making

GOTZ does not intend to make decisions based solely on automated processing that produce legal effects or similarly significant effects concerning you.

Payment, security, advertising or fraud-prevention providers may use automated tools under their own privacy policies.

Where applicable law provides rights concerning automated decisions or profiling, you may contact us using the details below.

19. Children’s privacy

The Services are not directed to children under 16.

We do not knowingly collect personal information directly from children under 16 without appropriate parental or legal authorization.

Where processing is based on consent, withdrawal is effective for future processing.

We will normally respond to a valid request within one month where the GDPR applies. That period may be extended where permitted because of the complexity or number of requests.

- your relationship with GOTZ;
- the email address or account associated with the request;
- the right you wish to exercise;
- the information or transaction concerned; and

Do not send a passport, identity card or other sensitive identity document unless we specifically explain why it is reasonably necessary.

26. Third-party websites

The Website may link to services that we do not own or control.

This Privacy Policy does not govern independent third-party websites, applications, stores, streaming platforms, social-media services or payment providers.

You should review the applicable third party’s privacy policy before providing personal information or using its services.

A link does not necessarily mean that GOTZ endorses the third party’s privacy practices.

27. Business transfers

If GOTZ or substantially all relevant business assets are sold, transferred, reorganized or merged, personal information may be disclosed to advisers and transferred to a successor as part of that transaction.

Any recipient will be required to process the information consistently with applicable law and any notice provided in connection with the transaction.

28. Changes to this Privacy Policy

We may update this Privacy Policy to reflect:

- changes to the Website;
- new products, services or integrations;
- changes to our business;
- new providers;
- security developments;
- legal or regulatory changes; or
- improvements to our privacy practices.

The revised policy will display a new “Last Updated” date.

Where a change materially affects your rights or how we use previously collected information, we will provide any additional notice or obtain any consent required by law.

Previous versions may be retained for legal and compliance purposes.

29. Language

This Privacy Policy is published in English for an international audience.

We may also provide a Croatian translated version.

Translations should be interpreted consistently. Where applicable law requires a particular language or interpretation, the mandatory local-language requirement will prevail.
